Terms of use.
The short version: the number is an estimate, never a reason to drive, you must be of drinking age, Apple handles payment, and your journal is yours.
The license
Clearline is licensed to you under Apple's Licensed Application End User License Agreement (the standard EULA). These terms are between you and IndieDeveloperJ LLC ("we", "us"), the Arizona company that makes the app. They add details about the estimate, your age, your records, the ad and Remove Ads, and are part of that agreement. If they ever conflict, the standard EULA wins.
The estimate is an estimate
Clearline estimates your blood alcohol from what you log. Bodies vary, so the real number can be higher. Never use it to decide whether to drive.
- Clearline doesn't measure anything. Only a breath or blood test measures blood alcohol. The app works a number out from what you log, the body details you give it and the time, using published formulas and rates whose sources it shows under How it works.
- Real bodies differ from any formula. Food, medicines, health conditions, how fast you drank, a drink poured stronger than logged, or a drink left out can all put the real number above the estimate, including above the high end of its range.
- "Back near zero" is when the estimate gets there, not when you are fit to drive, work, operate machinery, swim, look after someone or do anything else. Don't use Clearline to decide any of those.
- Clearline is not a medical device and doesn't give medical advice. If you're worried about your drinking or someone's health, talk to a doctor; in an emergency, call your local emergency number.
- Laws on alcohol and driving differ by place, and many places set limits below the ones people commonly quote, or zero for some drivers. Clearline doesn't tell you what the law is where you are.
Your age
You must be of legal drinking age where you live, and at least 18, to use Clearline. The app asks you to confirm this at setup.
Your records
What you add to the app is yours. It stays on your devices and in your own iCloud once sync is available and on (see the privacy policy). We never have a copy, so we can't recover it. Keep a backup somewhere safe if you want your journal to outlast a lost device.
The ad and Remove Ads
- The free iPhone and iPad app shows one banner ad from Google. Ads are chosen by Google, not by us; alcohol, gambling and dating ads are blocked. If one gets through, please tell us.
- Remove Ads is a one-time purchase ($9.99 in the US; the price in your country is shown before you buy). It takes the banner away on every device signed in to the same Apple Account, is shared through Family Sharing, and opens the other app icons.
- Payment is charged to your Apple Account when you confirm the purchase. Restore it on a new device with Restore purchase. Refunds are handled by Apple at reportaproblem.apple.com; a refunded purchase brings the banner back.
Limits of our responsibility
We work hard to make Clearline accurate and reliable, but it is provided "as is". To the fullest extent the law allows, we aren't liable for any loss or harm that comes from relying on an estimate, including decisions about driving or your health, or for indirect, incidental or consequential losses such as lost records. Our total liability for any claim about the app is limited to what you paid for it in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.
Governing law
These terms are governed by the laws of the State of Arizona, USA, except where the law where you live says otherwise.
Changes
We may update these terms; the date at the top says when they last changed.
